If the payments have been made to you in error, then you have to give them back, otherwise this is theft.
What other issues do you have with your old employer? If you left more than 3 mths ago, its now too late to take action under the Employment Act, although you would be entitled to redundancy if you worked for them for more than 2 yrs. If the company went bust, the Government has a compensation scheme to pay your redundancy.
I think you need to go and see the CAB for initial advice on your issues - they are free and impartial.
EDIT: Many companies have outside payroll bureau to run their payrolls for them - as long as the info they were given was only to enable them to pay the staff and was only used for that purpose, then there is no breach of data protection law.

You will be entitled to Legal Help if you earn under roughly around £12,000 - £13,000 per year and obviously if you have children this will be taken into account.
If the matter proceeds to the Court that's when you will apply for Legal Aid, which generally speaking, if you have been accepted for Legal Help you should be accepted for Legal Aid.
If you are not able to get any of the above most Solicitors do have a Special Rate for people just outside the boundaries of Legal Help/Legal Aid.
