Before she fell ill I became power of attorney for her checking account only. I currently pay her bills. She has no money left except for an annuity that was opened by a door to door saleman unbeknowst to me. Someone from her bank came to her house and opened this. One, I want to know if this is illegal. She was in her 90's. Also, how do you become POA of someone unable to speak for themselves. I have set up her funeral arrangements, no problem, I pay her bills, no problem, I am called for her medical decisions, no problem, but there are a few things I have no control over, such as the annuity, stocks, cancelling credit cards, etc that I think need to be taken care of before she passes. Any help would be appreciated.
You can go to local probate court and have yourself, or someone else, appointed as her guardian. If she doesn't have a lot of assets this is not actually necessary, but it does give you the legal authority to take care of things for her. Bless you for taking care of your aunt!
If you have court appointed POA you can handle all of it. Make copies and send to all the people that need references.
