Getting a patent, within the next 6 month-year?
Question:
And I dont want to just buy a patent and then be like "ok now what?"
Id like to find a company that does both gets the patent and starts producing the product. I'll sell it, whatever is cheaper and faster. Ive had most of my ideas for years.
Answer:
I agree with Joe S - find a competent patent attorney or patent agent (cheaper). You can probably find a list of patent agents in your area by searching the USPTO website.
Expect to spend $5K-$8K. You can save on filing fees by filing a provisional patent application. You can try to sell/license the invention while you wait. BTW, don't hold your breath waiting for the patent to be issued. The USPTO is overwhelmed with applications, it can take 2-4 years to get a patent issued.
Also, don't underestimate how hard it will be to sell/license the invention to someone who will produce it. I deal with patent licensing daily, and if I had a dime for every cool invention but worthless patent I've read, I'd be retired by now . . . Even the coolest inventions take some serious effort to get accepted/adopted.
Good luck.
Find a good patent laywer. For a patent to be worthwhile it has to be written correctly.
This is the breakdown
1500 to file a provisional patent application (using a law firm)
14-20k to file the patent application (a provisional patent app is good for one year)
2-3 years waiting on a review by us patent office
2-4k for every patent rejection counter submit
These numbers are subject to the number of "features" you are patenting.
Bottom line.they ain't cheap or quick to complete! Once procured you then need to find a manufacturer to produce the product.
There is a foundation called Triton who can help you with this. The man whi invented the Triton work bench went through all sorts of hasles getting his product on the market. He created this foundation to help people like you.
hi, first time answer(er). i have a patent i got by myself using the great book "patent it yourself". it took $700 and one correction from the examiner. the hardest was actually writing it. between the claims and the object sections i think my brain damage was short term but memorable. the maintenance fees are what get you. the thrid year i remember was $425, the 8th year was $1600 and the 15th year will be around $500. i'll help you with whatever questions you may have for a utility patent. good luck! PS - i gambled everything to market this idea and lost everything i had. don't want to scare you. i was a single mom, bought my home by myself (no child support or alimony) and thanks to home depot (who no longer is in business) i lost everything. i sincerely hope you gain luck and good fortune even without the patent. would i do it again? yes i would.
