Question:
No body has ever think about making this product from a different material (at least there is no one in the public market so far) which will give it a very particular characteristic, and I think it will be a success. It is not possible to patent this idea because the product and the material already exists, but the fact is that no body has tried to combine these two. Is there a way I could agree with a company to share my idea with them and if they are willing to try it, and it works get a % of the profits?, maybe having a confidential agreement signed first or something like that?. How is the right way to negotiate with a company about sharing ideas with them that they try and become a success?
Answer:
You say "It is not possible to patent this idea because the product and the material already exists" but surely your product is unique in its own right, and is using a different manufacturing technique.
Have you investigated this with the patents office?

Don't do it. U will get sued.
It sounds to me like you are out of luck. Possibly, the reason its not available in that material is because of cost effectiveness. The material may either be expensive, or the fabrication would be too elaborate to be inexpensive enough. I also really doubt that you could call a company, say "ive got an idea" and get them to sign some sort of agreement before they have any idea what your idea is or if it is worth their time. Even if you did sign an agreement beforehand, they could simply say they had already thought of using that material, and the idea is not new.
