If you're reversing and involved in an accident, you are at fault. Always.
It happened to me when a buddy saw I was leaving and he pulled in behind me to get my attention (Basically he cut me off). I dinged his Corvette door. It ended up costing me $1,600.00.
The insurance man said that it's always the guy backing up who pays.

Parking lot deals are usually no-fault. You pay for your own damage.

no its there fault they should have been keeping an eye on the road in front of them, hence they would have saw youi reversing.
and then they would have intisapated your actions better.
the only thing that is bad is they dont have insurance so you can not claim for the damage to your car
You caused that accident by backing up in a place where people don't normally back up.

when i see LOTS of wrong answers i cant help but put my two cents in because i hate when people mislead people when they dont know what they are talking about.
1. I dont know where people got that parking lot accidents are no ones fault and everyone has to pay their own damages. Thats a ridiculous myth. Parking lot accidents get investigated like any other accident and a liability decision is made.
2. The other driver is NOT 100% at fault as someone said. In fact, you will be the majority at fault if not 100% at fault. The othe driver was simply travelling through the aisle and had no reason to anticipate someone backing up out of nowhere in the parking lot. Now- in some situations that should have had time to take an evasive action (aka braking and honking) but you are DEFINATELY the most negligent of the two.
The fact that they were drinking and had no proof of insurance has nothing to do with liability. Those would be two criminal issues that the cops should take care of.
