Insurance co offers settlement, if I delcline, can I take it later?
Question:
Also, if I deline their offer, can I got back later and then accept it, or can they pull it back all together once I decline it?
Answer:
If you decline the offer because you want more you better be prepared to back up your counter offer because that's the only way they'll up it. Can you come back later and accept the offer? Sure. However, if new information is obtained to support a lower offer (like you misrepresented something) they have the option of pulling it off the table and replacing it.
Thats why you need a lawyer to handle the case, usually the insurance co. will offer as little as they can to make you happy and if you declined they might not get back with you for a long time if ever if you don't have a lawyer, you better get one.
Normally they would settle with you on what they offered even if it was later. Just go back and tell them what you want and why and see what they do. Personally, I wouldnt get a lawyer and pay him a big percentage unless he gets you more than enough to pay him and also get you more. Have the attorney write the contract that he gets a percent of everything over what they have offered. He probably wont do it though.
