Looking for legal advice regaurding an auto accident?

Question:
A year and a half ago my girlfriend was involved in an at-fault accident. He car was totaled, the other car involved was almost unnoticabley damaged. Yesterday she was informed that the driver of the other vehicle is sueing her becuase she has gone past the 50,000$ limit my girlfriends insurance has provided for her. My girlfriend was also underage at the time of the incident (if that's any kind of factor). I dont know much about this kind of situation, if anyone could shed some light the legalities and perhaps some of her options. Thank you

Answer:
She should give the summons and complaint to her insurance company (call them first, then send it by certified mail return receipt requested), and the insurance company will take care of the rest.

The $50,000 you are referring to is the "no-fault" insurance -- the kind that's paid out without a lawsuit. You friend still has a liability insurance (you are required to), which will cover the defense costs and any judgment or settlement.

Just tell your friend not to worry and do what I told you -- get the papers to the insurance company ASAP, and let them do the rest. They'll hire lawyers to represent your friend.
