GEICO cancelled my i collision coverage in one week , now denying to pay for accident happend on 11th day?


Question:
I bough my certified 2006 Mercedes from Mercedes Benz dealership on May 24th 2007. I insured my car with Geico for 6 months and paid in full on the same day for 6 months..

I got into a car accident on June 3rd, 2007 (on 11th day). Geico has denied my collision claim and has informed me that my physical damage coverage has expired on June 1st (in just one week) since I have not done a vehicle photo inspection on the car. When I signed up for my auto insurance policy by, the customer rep informed me that I need to complete the vehicle photo inspection within 2 weeks time (ends on June 6, 2007) and did not mention anything about my physical damage policy expiring if I did not complete the vehicle inspection. I have not received any documentation from Geico stating that my physical damage coverage has expired, I just checked my policy on Gecio’s website as of June 9th , and it shows my collision coverage is still active. Please advice what else i can do to win this.

Not surprised, it's Geico...they've got geniuses working there.

Print everything you can off the internet. Get all your documents together from when you purchased your policy, whatever correspondence you have received from them concerning the purchase of the policy, and the denial letter you received from them. Once you have this collected, make 2 copies (keep all originals) and send a letter to the claims adjuster disputing this assessment, and file a complaint with your state's Department of Insurance (most states allow you to do this online).

You can't win. You failed to live up the the terms and conditions outlined in the fine print of the policy, so your coverage was cancelled. It doesn't matter what the rep told you, because they will just deny that they ever said that. You are stuck.
Pile together all the information that you have on your car and regarding the insurance and accident and get an attorney who can represent you that is in your area. If there were any PIs (personal injuries) on you from the accident I would recommend looking for an attorney who can handle the PI part and who will also handle the lawsuit against Geico simultaneously.
Go after who gave you the bad info.
See if he carries errors and omissions insurance. You can google it.
you,ll have to get a real good attorney to fight this with,they have did a few people like this,and now their old insurance company's wont take them back again,their basically without insurance right now,i have a friend in the same position right now,and he cant find a reasonable rate anywhere right now,good luck,you have a good battle ahead of you.
You havn't had your car very long, see if the dealer has a photo of it on file, or whether a photo of it ran in any ads that would show that the damage is new. See if they have an inspection of your car on file that would show that the damage was not pre-existing.

I don't suppose you took pictures of your new car? Did it accidentally appear in any pictures? even in the background?

Gather that up also, and get your lawyer. It is common practice to refuse claims that are not attached to the letterhead of a lawyer. His name may be very important, and you may need only an hour of his time.
You can't win. Clearly you didnt read your policy throughly. It WILL state in your policy that YOU signed that you have to get that photo inspection within that amount of time or they will drop your first party coverages.

So yea.. good luck getting a lawyer.. all they will do is just read your policy (which you should have done yoruself) and then send you a bill.

You HAVE to get that photo inspection for that coverage.. otherwise you could have gotten in an accident prior to coverage and they would have to cover it.

I hope you learned your lesson and are more careful next time.
