Question:
I was involved in an auto accident in January of this year (there were 3 other cars involved as well; no injuries). I filed a claim right away. Damages were assessed by an adjuster, I was issued a check and had my car fixed. Anyway...when I track the claim online, it says the case is still open. How can this be? Shouldn't some kind of decision re: liability have been made by now?
Answer:
NO..1st party damages are always paid immediately upon proof of loss which is what happened in your case. 3rd party damages are entirely a different bag of marbles and the claim remains open until 1) damages to all parties owed is paid or 2) the statute of limitations runs, or a combination of the 2.
Is the claim still open because other people who filed against it have not settled yet? That's the only thing I can think might be why.
they are normally open for 2 years, you can claim veichle expenses and personal injury--
