Auto accident?

I was involved in an car accident yesterday..I was stopped @ red light and a car entered my lane and slammed into me..the guy that hit me was a mechanic driving a customers car..he admitted that he was distracted by a police car and rammed into my car..I'm now without a car and the business insurance is wanting me to pay for a rental upfront..I went to the ER after the accident and was told I have a severe back strain and to take the next three days off and stay in bed..what r my rights in this matter...I have never been involved in a accident before..anyhelp would be grateful..Attorneys are gratefully welcome to respond..thanks..

They may be in the process of investigating coverage and liability. Lets say they have determined both of those already...

Your rights are getting your vehicle repaired to pre-loss condition as well as being in a rental a reasonable amount of time. It is perfectly within their legal limits to have you pay for rental up front and them reimburse it.

Your rights for injuries are that (depending on state.. whether its no fault or not- lets say it isnt) the at fault parties insurance pay REASONABLE medical bills as well as lost wages. These again will be on reimbursement basis- not up front. You will "settle" with them at the end.

This is a minor injury.. you are not permenantly injured so dont expect to win the lottery and get "pain and suffering" or anything of that. You will maybe get 300-500 over medical expenses. "Back strain" is just whiplash. It will be better in a few days. If you get an attorney for a caselike this.. you will end up actually losing money b/c its so minor and they will take 1/3!

I suggest you call your insurance and make them aware of this accident. This is what you pay them for. Accidents can be confusing and they will explain to you how your state works. And please... dont run off to an attorney (im just preparing for alot of peopel to tell you to!) you sound like a smart girl.. you can do this.

Yes, you pay for your rental up front. Your insurance company or the third party will pay you back.
If the mechanic has insurance. it's possible they will pay for it. But if they business liability policy is giving you grief... I would contact an attorney ASAP. You might end up having to claim it on your policy, but only use your insurance as a last resort. Filing a claim with your insurance could mean higher premiums and a mark against your driving record. If you were not at fault it's not right for you to be the one to be out of pocket and inconvenienced. I would seek legal advice.
