Auto accident and Court?


Question:
I met an accident lasy year(my fault). Everything was settled between insurance companies. Now the lady filed a case that she had some other injuries. My insurance company has given an attorney for me. Now its being going on for 4-6 months and today I got a letter stating that the trial date is in Feb or 2008.

I may have to leave the country and might be back only after a year (Projects).. What are my options.. Why are they not able to settle this faster ?

Maybe it took all this time for your insurance co. to get all the facts, and analyze the charges.
Get your own lawyer and sue your insurance company for breach of contract. You have a legal contract with them, you pay the premiums every month and they agree to p[ay any and all claims against you. They have not paid a claim and have broken (breached) their contract with you.

Insurance companies don't pay claims because it costs them money. They let YOU get sued because it isn't their credit that gets shot to hell it is yours. All court judgments against you, even those paid (eventually) by your insurance company will be on your credit reports for 7 years.

Insurance companies will tell you you don't need a lawyer because they will pay for one for you. That is a lie they pay him/her to work for them not YOU.
Get your own lawyer and sue them then watch how fast they pay that claim to avoid being sued by you for FRAUD.
Here's some advice: Mr. My IQ 135 is an idiot. Your insurance company has provided you with a lawyer? Then ask him/her about your overseas trip. Your company DOES have an obligation to pay your claim but they have NO obligation to pay for non-related injuries or inflated expenses. They cannot pay more than your policy limits either so ask the lawyer what the heck is going on. Trust me, 99 & 44/100% of the time these things NEVER make it to a judge. Most likely the old hag has hired one of those lawyers that advertise on late night TV and is just bluffing.
Well, she's probably looking for a way lot of money - maybe more than your policy covers. If she's not willing to settle for your policy limits, then it's going to go to court. It takes a while.
The best advice is to talk to the attorney that the insurance company hired to represent you. He is representing YOU. And you should find out more about your case. Is liability clear? What are the damages claimed? How much in medical bills, or wage loss? What is the amount of their last settlement demand? What is the last settlement offer made by your insurance company? You should also know what your policy limits are -- so you can know if their demand to settle is within your policy limits. Are their any mediation sessions scheduled? Ask your attorney if he thinks this case will be settled before trial. When? In short, if you are the one being sued, you need to fully educate yourself as to what is going on. Then you will probably have a better sense for what the future holds. Your attorney is required to keep you up to date, and if he isn't doing so, send him a quick email, and request a meeting with him. (This is all paid for the by the insurance company.) Ask questions, ask questions, ask questions. With respect to the trial scheduled, find out if this is a "date certain" or not. Many times the court will "over-book" trials figuring that some will settle. Let your attorney know your situation --- regarding your trip. You may have to postpone your trip. That's life. Just remember that YOUR COOPERATION is REQUIRED under the terms of your insurance, and if you suddenly decide to not show up for trial, then there is NO COVERAGE FOR YOU. Thus, you would be paying any judgment out-of-pocket. One more after-thought. If liability is clear, then there may be a possibility that the defense could "admit" liability, and avoid that part of the trial. Then you probably won't have to testify. Just a thought. Your attorney can give you more advice too. Good luck. You didn't mention what state you are from, and state laws and courts differ. So my advice is somewhat generic.
