What should i do in a no fault auto accident?
Question:
Answer:
Tell your insurance claims adjuster your version of the facts. Depending on which lane the point of impact happened, you may have less fault than the other driver. Just because the other driver had a green light, they have the duty not to enter into an intersection until the intersection has been cleared and it is safe to enter the intersection. ALWAYS try to get a witnesses information when ever you get in an accident if you have any. Otherwise it is word against word, BUT you will most likely have a portion of the blame for the person turning left usually does own most of the blame.
get a lawyer... you had the right of way considering that you had crossed the white line BEFORE the light turned red. if you dont get a lawyer u are pretty much skrewed becuase u will never win against a cop.
No don't get a lawyer - this is what your insurance is for. Your insurance should handle the claim the other party makes - hopefully you have decent insurance and not survival or something like that. You might as well call the other party's insurance that hit you and file a claim with them saying their insured hit you. Honestly, this should all be handled by your ins. company.
all I know for a fact is you only have up to 30 days from the date of the accident to report, talk to lawers,etc...due to statue of limitations, after 30 days your automatically guilty, happenend to me.hurry dont wait..get a move on ...trust me
Was there a police report taken? I'm assuming that there was no left turn lane and you entered the intersection to turn and was caught as the light changed thus technically making you illegally turning into oncoming traffic. You need to get a copy of the police report. In any accident you should report it because it can get very costly. That's why we pay into a policy so that we could have some helping us out. I can see this going bad for you financially because the other party has drew first blood and can begin trumping up the pain and suffering, medical etc.. As for insurance companies using stats, it 's true. They've use them all the time and that's how they come up with the premiums. P.S.This will not be a No-fault Accident. Good luck
If the Police made an accident report, then call them up and send necessary fees to get a police report. Find out whether any CCTV were nearby that may have the video. Depending upon the claim amount and your financial condition, think about hiring a lawyer. The retainer fee is often hefty at a good law firm. Ask questions to your insurance company and make sure they fight for you. Do not talk with the other insurance company and tell them that you were turning on red.
I hope this helps.
