I was in an auto accident that was not my fault! I have reported to my insurance com. but she has notwhat hap?
Question:
Answer:
Your question is STATE specific. What state are you in? Is it a NO FAULT insurance state? You say you reported it to your insurance company but did you fill out a poilce accident report? You need to call your insurance agent to see what's covered. Too many variables here because every state is different.
Your insurance company will not make a police report on your behalf. In most states you are required to make a report or your license will be cancelled/revoked if you fail to do so.
Everything has to be in writing. You need to review your policy. Your agent will do the minimum for you especially if the other person is at fault. Getting you all fixed up may lie soley on the at fault person's company PROVIDING SHE IS INSURED. Once again this is all state specific, there is no one single answer on here.
If she is liable for your property damage you may report it to your insurance company. You will be responsible for the deductible. Once the claim is paid, your insurance company will "subrogate" for the monies paid out, both by you & your insurance company.
If the responsible party does have insurance then it would be in their best interest to reprt the claim as your insurance company will want to be reimbursed & can take legal action to collect.
If you turned her info in to your insurance company, they'll report it on your behalf, agree on fault with the other carrier, and the claim will be settled eventually.
If she denies involvement, or fault is in question, it can take a long time - in which case your insurance pays, and they reimburse your deductible if they ever collect under the other policy.
No matter what state you are in, the first thing you need to do is find out the cost of repairs and send her a letter asking for compensation. If she never reports it, and you never ask for it, you get nothing. Keep in mind, if she was at fault, she owes you. If the insurance company compensates her for what she has paid you, good for her. But SHE owes it is she was at fault.
