Is it better to take a person to court myself of an auto accident or should I let the insurance co do it.?

The person that hit my truck refuses to call his insurance co though he is 100% at fault. Can I take him to court myself or should I just pay the deductibe, go thru my insurance and seek re-embursement later?

Answer:
let your insurance co take care of it..then make a small claim later for any out of pockets.
YOUR insurance company should be doing that.
definetly let the insurance company handle it - that's why you pay insurance premiums.

have you thought about maybe he doesnt have any insurance?
Who got the citation? If you didnt call the cops you probably have problems.

Go with what's behind door number 2. Way easier for you, no cost (except that deductible) and if he turns out to be uninsured you don't have to be the one trying to figure out how to get blood from a stone!
