Can I collect in small claims court on auto accident?

The other party did not report the accident(although I reported mine to my insurance agent)

Depends on your state and if it is a "No Fault" state. In which case, if the majority of fault falls to the other party, you can generally only sue up to $500 to cover deductible (Which is why some people care Mini-Tort on their insurance to cover this if a judgement is made against them). Also, if insurance is required in your state, then you may not want to go down this road since you would end up incriminating yourself by admitting you didn't have insurance in the first place at the time of the accident.
Absolutely! Go to your county clerks office and ask for help in filling out the paper work, what kind of documentation you need and the filing fees. He or she will be happy to help. It's a poor mans lawsuit and it works!
