Who do you complain to in this bureaucaratic IRS system?

Who can you complain to the IRS about? My boyfriend claimed our child two y.o child for the Feb 05 tax season (last years). However he has been given the run around since then with submitting documents and proving he is the father. All forms have been submitted and when he calls weekly they say it is still being processed. The new tax year is coming and we want to get this issue resolved before it happens again. We think the problem is that he claimed 1 on his w-2's and didn't change it after our sons birth. However, shouldn't the IRS be able to work around that by telling him to change his dependant status and fix this small problem. By the way he files his taxes on his own. Anyway, how in the heck do you go about proving you are the father of a child (he's been here since birth) besides the birth certificate, ss card.

To answer your question simply, there is a Taxpayer Advocate within the IRS. See the link below and read ALL the links on that page so that you understand what can and cannot happen. You have the right to a speedy resolution and you are right to be thinking about this before the new tax year.

If the taxpayer Advocate is not for you, perhaps you could take all the correspondence between your boyfriend and the IRS to a CPA. I would suggest you take a copy of your tax return as well and make it a joint appointment. Whether this is a good idea does depend, though, on the amount of money involved.

Although you have given a fair amount of information, there are lots of variables which are best discussed face-to-face, rather than in a forum like this.

Incidentally, I agree with the previous poster who doubts that it has anything to do with the withholding allowances claimed.
W-2 has nothing to do with it. Maybe you are also claiming him as a dependent?
It's always a good idea to contact your US Representative and US Senator. They have people on their staffs who look into these matters and help you resolve these problems.
Go to IRS.GOV and contact the taxpayer advocate. That office is there to help with these situations. Good Luck!
The problem has to do with a change in the law last year concerning unmarried couples claiming children. In particular if one of the adults is not the parent. Thousands of people got the same letter you got. You can try the tax advocates office as suggested or you can go to an IRS office and speak to a supervisor. Your W2s had nothing to do with the issue. Next year have a tax professional do your taxes. You are paying now for doing your own without an understanding of the new law.
