Help i have x-husband tax problems!??

he clamed my kids on his taxes but i have been supporting them since he left 6 years ago. i tried to do my taxes and got denied becuse some one already clamed my kids. i asked his girlfriend and she told me he did clame them! i also tried to call the irs but that was hopeless ,what do i do now pleas help?

Was it spelled out in your divorce decree who would claim the children? If it is, then that should be your guide.

You can file by mail and let the IRS work through it, or contact an attorney for advice on this matter.

claim them anyway, mail your return, the IRS will get them anyway and he will be in major trouble
File your return, claiming the kids. You won't be able to efile, so mail it to the IRS. You can include a note explaining the situation, but don't have to and it probably won't make much difference.

Since the kids are claimed on two returns, the IRS will send both of you a letter asking for proof that you are the one who is allowed to claim them. Unless there's a court order or you have given him written permission saying he can claim them, you're the one who is eligible.

After the IRS gathers all the info, they'll disallow his claim and he'll have to pay back whatever he got by claiming them, plus interest and possible penalties.

You'll get your refund. Unfortunately, it will probably be delayed while the IRS sorts this all out.

Assuming that you are the custodial parent, you'll have to file a paper return. This will trigger an IRS investigation. Respond immediately when you get the notice from the IRS. The IRS will then determine who gets the exemptions. This will be you. They will then process your return with your exemptions intact. HE will get a bill from the IRS for the taxes due on the disallowed exemptions.

Unfortunately this will delay your refund. It's a typical tactic pulled by nasty ex-spouses. Your best defense against jerks like that is to e-file at the earliest possible moment and beat him to the exemption. In the meantime, follow through with the paper return. You WILL get the last laugh!
Hi Cilla, Write a letter to irs,and explain like you just told us. That you are the supporting parent,and have been for 6 years. Believe me,they will go after your husband,and he will be in trouble.Also,asked them went you can do your income tax with them as a tax write off. You will get your credit. A Friend.
P.S. Make sure you write your s.s. # on your letter.
