I got a letter from Human Resources depart. of a job I applied for and it wanted me to clarify my background..
Question:
"pending". My question is.. Is there any specific buzz words or law lingo I need to use to explain to HR that this was foolish on my part and I am a good worker. (my references and education came back good). They told me in the letter that my application was pending, and they wanted to give me a chance to clarify my background before they make a hiriing decision. So I'm assuming if I gave them a good story and further highlight my accomplishments, that they will hire me. Please someone help me. and please let me know why the first charge showed up on the background check!
P.S there was no convictions at all,

There must be something you wrote that they don't completely understand. Hence, the word, CLARIFY. At this point, they just want to ask you some questions.
You don't need a good story, you need to tell them the truth. The reason the first offense showed up was because you got the second one. Most likely, the first was what is called in contemplation of dismissal, which means it will be "wiped" out if you don't get into trouble within a certain amount of time. I am "assuming" that you picked up the second charge within that period.
You don't say how old you were when these occurred. You could explain that it was foolish childish behavior that you regret. Life is a series of experiences, hopefully this is the one where you learn that crime doesn't pay. It has come back to hurt you. Good luck with the job.
I can't help with all of your statements, but I can explain some things.
A criminal background check will show ALL your arrests and dispositions. Nolle prosse is actually nolle prosequi and is considered a disposition. Nolle prosequi is a Latin legal phrase meaning "to be unwilling to follow through or more simply unwilling to pursue." (from Wiki, below..). According to your record you still have a criminal action pending, have you checked into that?
An employer would want to know more about your "pending" legal troubles then something that happened in the past. Also they are probably concerned that you didn't learn your lesson the first time and got another charge for the same offense. Also, consideration has to be made concerning how long ago these things occurred (last year or 10 years ago). In addition if the job you are applying for deals with merchandise or money it probably will give your potential employer pause in hiring you.
Giving a good story (embellishment) would not be advisable especially if you were less then forthcoming regarding your arrests.
