I need help with my unemployment appeal hearing?
Question:
How do I make the appeals judge realize that my former employer is lying and I did not quit? I am a single mother who needs health insurance and money- I never would have quit, I put up with harrassment for months before I complained and then when I did I was fired.
Answer:
You need to file for unemployment, this will start an investigation, state on your application that you were let go.
They will have to PROVE you quit.
Also, contact the BBB (better business) and file a complaint against your employer. Included the allegation of harrasment.
Then contact the EEOC (equal employment) and file a complaint with them.
Doing this will get independent investigations going against the employer.
You should get an attorney (most will take your case and not charge unless you get money) who could/would file the appropriate complaints.
This happened to me many years ago, I complained about bein sexual harrasment against my direct supervisor. When I filed the complaint, they assured me they would take care of it. Well I was fired, I did the above and the BBB and EEOC found I was released injust and was sexually harrased. The employer settled out of court for 2 year of wages.
Good Luck
take all your proof and any witnesses and tell the truth. my wife did that and won her appeal. the hearing is informal, just you two in a room with a judge. you will be ok.
You need to prepare the facts for the appeal hearing.
1) Get a sheet on paper
2) On the left side list everyone who is involved in your claim by name including yourself
3) On the top of the sheet note the important dates
4) Under each date make a box and write in what happened and by who
Go to the hearing and tell you story truthfully, without emotion of anger. If the truth is on your side...you win. The hearing officer is impartial and pre-disposed to err on the side of the employee. Just be credible and leave extra information, future employers being noticed, out of the discussion.
did you ever receive anything in writing from the company saying you where fired?
