What action can I take against my apartment management?

Question:
I live in a new apartment complex and we have been there for 8 months. They haven't assigned parking stickers or anything like that to the residents and there is no parking when I get home (I mean 0 parking spots). I have always parking on the curb because there was no parking spots but this morning my car was towed. Apparently they painted on in white letters "tow away zone" on the curb yesterday and by the time I got home I couldn't see the "tow away" letters. Is there anything I can do? Can I take them to a small claim court for not even giving me a warning? Can I break my lease because they said in our contract they would provide me with covered parking and yet there is no parking at night? Please help!
many actions
What state are you in?
well that is a breach of contract so you can talk to a lawyer about small claims court.
Sounds like you should have tried to resolve this problem awhile ago. You can't break your lease because they didn't fulfill their end. Go to the office and speak with them about the situation before it festers.
They are the ones who broke the lease. Have you discussed what happened with them?
Was the curb on a city street?
You parked in a space that was marked Tow Away Zone - I doubt the court would make them pay for that.

Your case hinges on a promise that you say they made in the contract yet they have failed top meet. In order to get anywhere with that, you would have to show that you tried to resolve the issue (in writing) before any court will take the case.
I would try. It looks like you are in the right if they did not provide the parking that they said they would. I had my car towed from my old apartments and never got it back because they wanted $500 plus everyday that went by that I didnt get it they added $30 to it. Good luck!
if they said in ur contract that the cover ur parking and thier not then the already violated the contract so take them to court and get a lawyer to talk with u first so feel more confident.
Since the curb was marked, you probably can't collect for the tow fee. Who towed you? The city or the apartment complex? Because if it was the apartment complex, you could receive the money back. That happened to my fiance when the apartment manager had his car towed accidentally. She ended up waiving the fee.

Is it in your lease agreement that you are to receive assigned parking? If so, that's a violation of your rental contract. You have to push your apartment manager into giving you the stickers.
Are you sure this wasn't an action from your city? If so, they are obligated from their lease to expand their parking area.
You have some recourse in this case.
