Question:
I recently bought a rental property. 2 weeks before closing, I was told that one of the renters was being evicted for failure to pay his month to month lease. At closing I was assured that he was gone. But he wasn't. I have never met the guy, and the property was sold to me as thought that side was vacant. Turns out the prior management had never signed a contract with him at all. No one has heard from him in almost 2 months. Some of his things are gone, but not all. He has no phone or contact information. We are treating this situation as an abandonment. The question that no one can answer for me is how long do we need to store his stuff before we can dispose of it. Is selling it an option once that period is reached? Any help would be greatly appreciated.

I don't know about Texas, but here in MA, it is 9 months.
It happened to us when someone abandoned their property in my 3 family house, but I wasn't about to get sued over it, so to be safe, we called our local courthouse and they told us 9 mos.- after that, we had a yard sale and reaped the benefits of having had that stuff in our house, unwanted for all of that time!
We never heard from the person again either, but it is better to be safe than sorry where real estate is involved. You wouldn't want a legal battle or lien placed on the property.
look in your white pages under Renters Rights or Renters Advocates...the can tell you about your particular area.
in California, it is 30 days of storage with a letter being sent registered to the owner of the property. the letter will detail the amount the needs to be paid in order to release the belongings. at the end of the 30 days if the owner of the property has not paid, then the property can legally be dumped or sold.
so check with your local renters right association.
