On pre-employment job screenings, when they run blood and urine tests, can they check you for pregnancy?
Question:
So now I have a company that has offered a job to me, but I didnt tell them (Im actually within my rights not to share that), but Im wondering if when they run blood or urine tests that will show up. Are they within THEIR rights to look for that without my permission? I would think that they don't check that.. they usually only mention that its a drug screening..??
Answer:
You are under no legal obligation to disclose your pregnancy and what I find more disturbing is the job that decided not to hire you when they learned you were. Did they actually say this or are you assuming this? If in fact they actually said this to you you would have had legal grounds to sue on the grounds of discrimination and file a claim with the EEOC (Equal Employment Opportunity Commission.) Drug tests overrall is to check for drugs and NOT pregnancies. They are not allowed to check for possible pregnancies. In the event you are hired and let go due to the pregnancy again you have every right to pursue legal action against them.
Legally I don't think they can check.
No they don't check. I just did a job screening and I asked the technician if they would have that in the results and she said no. So you're safe. Congrats by the way!
You are under no obligation to tell them so unless you are in a position that is necessary for them to know for your safety. (for example...lifting) Because you are dealing with medical records, the only thing that the lab can and should divulge are the tox screen results which you have agreed to in writing. I am a little concerned that another place refused to hire you based on that. In today's world, that is discrimination UNLESS the job you are doing would be compromised. Don't worry about the drug screen.
It is illegal to make such tests in most countries. But they could ask about your physical and health situation in the interview. I suggest you just keep quiet about it. However, you will be on a probationary period for at least three months and when they find out they could terminate you.
Peace and blessings!
Voni, they hired you because of trust and honesty. You signed a paper to do the tests listed. If pregency is on their. You will be looking for another job. You signed a paper giving then permission--As a condition of employment. By submitting a job application. Be a good girl and let someone else who needs a job be considered for the position. Seems to me that this a joke--cause you will leave the company in 5 months when you are not able to work. They have to go thru the hiring process again.
I have never had a blood test for a job, only the pee-in-the-cup thing and I guess they could test you for pregnancy but i think they are only looking for illegal drugs. I would not consent to a blood test because they don't need my blood and it could conceivably be tested for every disease and genetic problem you could think of. They have no legitimate reason for bloodwork.
