Does anyone know if stress on the job can be filed under the work-mans compensation?

I've always heard that when stressed on the job and it causes emotional problems you can claim workmans comp... My boss keeps belittling my religious beliefs with his somewhat off color comments and it's somewhat stressfull. It isn't quite harassment but what he does is quite bothersome. It plays a role in my life at home and I tend to be easily aggitated with the little things within the household. So before I seek help with our health plan, I was wondering, could this be a work related injury?

As others posted depending on your State it may or may not be a W.C. case (in my State it is.) I would definitely advise you to begin seeing a doctor immediately to begin documenting medical proof to substantiate your claim. Additionally, you definitely would have a case with the EEOC (Equal Employment Opportunity Commission.) This would fall under Title VII of the Civil Liberties Act. If you file with the EEOC and they take your case (which I would bet an entire year's salary they will) if your employer fires you it would then be retaliation and strengthen your case. You can call the EEOC at 1-800-669-4000 . I would also find an Employment Lawyer. You can contact the National Employment Lawyers Association (NELA) who specifically take cases of individuals against employers who are in violation of there employee rights. Laws vary by state. In California, stress-related disability can qualify for workers' comp. In most other states, probably not. However, what your boss is doing can be considered harrassment and creation of a hostile work environment. You might want to seek out a lawyer or talk to someone in Human Resources.
That's called discrimination and harassment. You should contact your HR department. I see tha California does classify it as WC, but not in Michigan. If so, I would have been on it :-)

But seriously, please do contact HR, you cannot work in a hostile environment like that.

but i understand how you don't want to call out your boss!
they sign your pay check hell iw ould be scarrereeeddddd!
You will not get Workmans comp for stress that can be removed by some other action!
plus how can they prove it's your boss belittling you that is making you stressed! if you drive that can stress one out!
now if your job made you take some sort of pill to keep you level headed you may be able to right off the meds but that's about all!
well see i could be wrong you could try to go for it but i feel that your chances of winning are at most 3%
your not injured you just need to learn out to release your stress! and that my friend is one of the hardest things a human can learn!

i would ask your boss in a nice way say someting like
" i understand we don't have the same beleives with our faith but your off color comments are not really professional nor are desired. I am telling you this verbially if it does not stop i will take further action upon procteing my rights as an employee with this company." be nice and try to talk it out !
Maybe your boss is just seeing how far he/she can push you!
STICK UP FOR YOURSELF no one else will!

It is harassment if it bothers you. If you have talked to him or his supervisor and he still refuses to stop, you can complain to your labour board or the human rights commission. If you are unable to work and can't get workers' compensation, talk to your doctor about a medical (short-term disability) leave.
