Is it legal to use a QAM tuner for local HD channels?

I have learned that it is possible to use a device called a QAM tuner to pick up unencrypted digital content from a cable company without paying for cable. What I'm wondering is since local HD channels are broadcast via the 'airwaves' is it legal to pick them up via a QAM tuner instead of putting up an antenna. I live in the US, South Carolina in particular.

Absolutely.

The reason why some digital channels are unencrypted is because they are included as part of the Basic Cable lineup. For most cable systems, Local HD channels are part of the Basic lineup.

Keep in mind, sometimes the cable company is unaware (or too lazy, apethetic) that other digital channels are unencrypted (e.g. TNT-HD, UniversalHD, etc). The rules/laws are murkier for those situations. Personally, IMHO, if they send it out unencrypted, then it's fair game. For the most part, they encrypt everything but the local HD channels.

I don't see why it wouldn't be legal, since all a QAM tuner does is, it allows you to connect your digital/coaxial cable directly to the TV, without the need for the cable box, but you still have to pay for the digital signal.
