Home Owner's ASSociation vs. New Solar Tax incentives?

Question:
I am installing solar panels on the roof of my townhouse in VA. The HOA has contacted me and says their bylaws do not allow for "any alterations to the stucture". (not sure how dorky satellite dishes seem to get a waiver on this, but never mind that).

what is the best way to beat these little sh*ts? I hear they have their little fiefdoms and can be petty little school marms, so who has ever outsmarted them, tricked them, or out-lawyered them?

Answer:
Since the 'alterations' you want to make will have little impact on the aesthetics of the structure and also is a responsible thing to do from an environmental standpoint, I would try going to a meeting of the HOA and plead my case in person to the people who make the decisions. Perhaps they will see the merits of your plan and agree to change their by-laws to allow certain alterations when there is a compelling reason to do so. Then if the still don't acquiesce, that's when I would start planning to destroy them.
Be prepared to spend big bucks. Be prepared to loose. When you bought the townhouse, the by-laws were part of the contract. You are trying to alter the contract with out the agreement of all parties concerned.

Satellite dishes are regulated by the FCC and they have pretty much nullified HOA rules against them as prohibiting dishes prevents the reception of a licensed broadcast by paying subscribers.
Some courts have been known to rule in favor of solar power. Check your local laws. I don't know how much this varies from place to place.

You are certainly not alone in fighting your HOA.
