How long after foreclosure sale do i have before i have to move in texas?
Question:
NEXT DAY. once some one has been to the title company and bought your house... you are to go asap. The buyer may grant you a few days if its in his interest .
I think they have to go thru the eviction process to get you to move. Look for something on the eviction process in Texas.
Normally speaking they will not confirm the sale in court for 8 to 10 days following the sale. After the sheriff deed is issued at the confirmation, the buyer can get the sheriff to issue a 48 hour lockout notice. After the 48 hours a sheriff will lock you out and any remaining property becomes the property of the new owner. My advice is to talk with the new owner and in a lot of instances they will offer you some money to move quickly and not damage the property and to clean up on the way out. Referred to as cash for keys - Never hurts to ask
You're probably looking at about 3-4 weeks before the actual eviction takes place. This is because the sheriff sale of the property will usually be confirmed within the 7-10 days after the sale, and then the lender will initiate the eviction process.
The lender requests the court to grant them possession of the home, and the court orders the county sheriff to make sure the property is vacated by a certain date. This can all usually be done pretty quickly in Texas, since there is no redemption period after the sale.
You can try to negotiate with the bank for an additional few weeks, if you need time to find a place to move into, and they may be willing to postpone the eviction process. They don't want to see the house completely torn apart and gutted, and if giving you extra time will make the transfer as amicable as possible, they are usually willing to accomodate a few extra weeks. But ask them for this directly, as it always depends on the specific circumstances of the entire foreclosure process up to that point.
Good luck.
