I have rental agreement, but landlord went into foreclosure & bankruptcy & we have to move. What are my rights
Question:
Answer:
This is a tough one. Depending on your state your rights are different. For example in NY (which is very anti landlord) your lease would be upheld until building hell freezes over. I'm not quiet sure who is buying the house (the owners are usually the landlords) but either way, you - the tenant- will get inherited and they can't get rid of you until sept at least.
Rival
firstly they must give notice to you a minimum of
3 months
secondly they must either fund your living expenses
whilst looking for a new home which
they are also responsible for
as there is no failure on your behalf
(rent payments etc.)
It all depends on the state you live in. Actually, I think within certain states, it's different from county to county, city to city.
HUD has information for each state - http://www.hud.gov/renting/tenantrights. Check to see what the law is in your state. I live in California - we have a renter's handbook http://www.dca.ca.gov/legal/landlordbook... that gives a lot of helpful answers as well.
Good luck!
