Only when the foreclosure procedure is complete does the lien holder have rights to the rent money.
You still have to pay rent. His being in forclosure does not affect your legal rights at all.
It is only in foreclosure it has not been forclosed on so yes you still need to pay the rent to your landlord he is still responsible for repairs He can pay it off or work something out still and until it is forclosed on he is still the landlord.
You have no legal rights regardig not paying a rent no matter the stattus of the owners situation. You intered an agreement to pay x dollars to live on the property, period.
You do have a responcibility to the owner that comes with his legal rights to collect rent from you till you are requested to move.
You also have the responcibility to yourself to act in a rightous manner in your dealings with others. Not doing so can leave you with the stigma of being a dead beat, and on a black ball list to rentors. It would follow you.
You have to keep paying him rent, as detailed in your lease. You may be able to get out of the lease, but if you plan on staying there for a while longer, the payments will have to be kept up.
If you want to get out of the lease, you can claim constructive eviction, which means the landlord is intruding on your rights to live in the property so much that you can not experience quiet enjoyment of it. A pending eviction by the county sheriff may be able to qualify under these guidelines, but you'd have to consult with an attorney, most likely.
You could also try buying the property out of foreclosure, if that's an option for you at this point. Having made all the rent payments would look to the mortgage company like you can make a mortgage payment, and that would help you.
