I got the wrong rate at closing and now my mortgage is in contested foreclosure, I rescinded the loan, but th?


Question:
court is giving me a hard time granting the rescission, they think I just don't want to pay, but the proper disclosures were never given and they still can't find some of the original loan papers, what can I do?

Answer:
You either you are trying to welch out on the loan or the lender is a pirate. Either way, you are at the mercy of the court. You better find a way to prove your position.
The court may think you don't want to pay but you may not know that your loan was probably sold and that is why your rate changed. The court knows this and can give you a hard time based on that fact.
