Exactly how long do i have to move out before my house is taken away for foreclosure in CA or does it vary?

Answer:
Once the bank decides to start the Notice of Default then you are looking at 3 months from the NOD filed, they will set a sale date (auction). This can be anywhere from 2-4 weeks from the end of of the 3 month period. So you are looking between 3-4 months. However, most mortgage companies usually wait a couple of months before actually filing the NOD. Once the house is sold at auction you will need to get out that day or they will have the sheriff's come and remove within a couple of days if the house didn't sell at the auction.

Do you not have any equity in the house to help you out until you sell it? Talk to a lender and see what your options are. Keep in mind the bank can advise the IRS of the difference owed and amount sold for and it becomes taxable income on your behalf. Ouch!

Well let me first say that I am sorry that you can't pay your mortgage.
If you know that you can't make the payment, then pack your stuff up and get out.
It's not fair for you or the company that holds the title to your property. Don't sit on your property until the sheriff's dept comes and kicks you out (Believe me...you're going to feel really bad and stupid about that.)
If you can't make the payment, call your title company, or mortgage lender and explain the situation to them...at least give them a heads up...have some dignity...get your shi* and get out. It's so much harder if you act like it isn't happening.
