In CA, if my husband has accounts in collection, bad credit, and is facing foreclosure?
Question:
Answer:
Yes it CAN affect your credit. He purchased the house while you were still married therefore all debts are still 50/50. The collectors CAN and just might come to you for payment regardless of your last name or whether you were on the house. California is a community property state anything owed by one is owed by both. I suggest you get this crap cleared up pronto or you could be facing the creditors in court.
if it's in his name it's his..you said you have excellent credit.
As long as your name is no where in there connected with his,but if it list your name also(you would have had to sign for that)then it's only his.
I had one of those - just maintain your own accounts - no joint accounts, no joint credit that you're not willing to maintain yourself. Utilities should be in one name.
Never use your social security number on his obligations and you'll be fine (worked for me).
I really doubt it will have any affect on you. If the house is ONLY under his name it will not affect you at all.
only if you have shared accounts. Do not co-sign for him otherwise your credit scores will be brought up together. Typically you have individual credit scores..so just keep the finances separate for a while.
Dear NewAge,
California is a community property state. You have a mess on your hands. You are still legally married. So, his motto that 'his money is his money and your money is his money' will also apply to your credit. Not good for you at all. See an attorney soonest!! Good luck.
If your name and your credit are clean, don't worry about when you will get divorced;he is he and you are you.
keep everything in you name only and never never co sign for anything good luck
your credit report always shows up that you are married, you get one free a year from all three agencies, call up one and get it, that leaves you 2 for later on,
it is a wise move regardless
he may have used your name somewhere,
Sorry dear, you live in a community property state, what's his is yours, and what's yours is his.
