Foreclosure on a home her childrens' father owned?

If your childrens father and yourself are not together but she has lived in a home he owns with thier 5 children rent free w/ $100 a week child support, that was only ordered because she was living rent free only. And the home is now in foreclosure, what rights does she have if any? her and her children will be homeless and were given less then two weeks to vacate and were offered a $1000 to move by the specified date. Is this legal?

Answer:
Check with children's services first of all. If the child support order is based on providing a residence and he is not able to do that, it will change the terms. Other than a possible conflict for "parties in posession", something an atty would have to look at in your state, there isn't probably much else you can do if he's losing the property in foreclosure.

Child support is ALWAYS modifiable. This means that it can always be changed. Go to your local superior court of your county, and ask there how you can file to modify the child support. Explain the foreclosure situation and ask how you can get the court day faster. They will give you forms to fill out. And then on the court day the judge will increase the child support amount.
