How should we pay rent to our landlord if the house is going to be auctioned at foreclosure 10 days later?
Question:
Answer:
Acording to your lease untill you recieve specific notice that the foreslosure has taken place, the residence has changed hands and a new owner is giving you the option to move out or renew your lease.
What does your lease agreement state? If you don't have one, then I would contact a place that helps with landlord/tenant issues. Most bigger cities have places that you can call up and meet with someone. Call your city hall or maybe your county clerks office to find out the name of the office.
Don't make assumptions. Find out what is the proper legal thing do to.
You are right ot be concerned, tenant rights vary from state to state...you should call your local legal aid firm...I agree that I wouldn't pay when there is no guarantee who you will owe the payments to...but keep in mind that a forclusre doesn't happen instantly...after the forclosure sale the owner has 6 months to bring the loan current and keep the house, so he could bring the payments current and then evict you for not paying your rent.
