How do we know if our house has been auctioned during foreclosure?

Question:
We got the noticed attached to our front door that our house (michigan) was scheduled to be auctioned on June 30th. We have not heard or received anything since then. We know that we have 6 months from the date of the auction to move out but we arent even sure if the house was auctioned that day for sure. Who do we call to get more information? The mortage company?
Where did you get the idea that you have six months to move? It probably takes six weeks to close the sale after the auction, but if it takes a week past that to get you out, I'd be surprised.
On your default notice it should state the attorneys office the auction was being handled by. It really isn't a concern of that office or the lender to let you know anything about the sale. Since you were given a date of June 30th, I would move now. You do not have 6 months to move as whoever bought the house will want to move in quickly. Just remember you are legally responsible for the amount of money owed with the difference between what the lender is receiving and what you owe. Foreclosure does not mean you are free and clear.

If you decide to buy another home, be aware that the lien from this house must be paid off before you can close on your new home and it will be on your credit report.
please visit this site...it will tell you the foreclosure process for each state and how long it takes for each step to complete.

good luck ♥
Call the trustee on the notice, They will be able to tell you if someone bought it or it went back to the lender. You can also check with Assessors office and they could tell you. Also you do not have 6 months to live there from the time of the auction. It sounds like no one bought it at the auction because if they did they would be knocking at the door wanting you out so they can re-sell it. The lender is probably swamped but they will be out to make sure you are out. An appraiser will also be out soon. So start packing before the sheriff shows up and puts all your things on the sidewalk.
Call the attorney's office on the foreclosure complaint. They will have the most up-to-date information on your particular foreclosure.

Hope this helps...

You can call any of three sources to find out what happened with the house. In fact, you should probably call all three to find out, because most of the time, people you talk to will be incompetent or just have no idea what is going on.

You can call the lender's foreclosure or loss mitigation department and talk to someone there about your home. They'll be able to tell you when the house was supposed to go to sheriff sale, and if it has, or if it was postponed, etc. If it went to sale, you might have to call the REO department (Real Estate Owned), to find out the current status.

The lender's attorneys will also be able to tell you if the house was auctioned off, because they are the local reps for the bank and file all of the foreclosure paperwork. They know when the sale is/was, since they are the ones that do the publication and send you information in the mail about the sale, if these actions are required by state law. But they should also know what happened with the property.

The last place to turn to is the county, usually the courthouse or the sheriff's office. The courthouse is probably the best place to start, since the courts handle the foreclosure process. However, it is the sheriff's department that actually auctions the property, so calling them can also get you the information you are looking for.

Again, though, you might want to call a couple of these sources, as you'll probably find yourself talking to some low level clerk or brand new employee in India, who won't really know what is going on and doesn't have any up-to-date information for you. Plus, a call to the lender is usually a half-hour time commitment while you wait on hold and are transferred from one person to another.

Good luck.

I am confused. You would be evicted when the lender foreclosed on the property. You have 30 days to move out from the notice of foreclosure. After foreclosure, then they auction the property. The person who purchases the property can move in as soon as they pay for it (or as soon as their mortgage is approved).

You certainly don't get 6 months. You should call your mortgage company right away to find out what's going on.
In Ohio, the sale is confirmed 14 days after the sale at foreclosure, the sheriff would come and set you out of the house, your possessions would be put on the front lawn. You need to call your bankruptcy attorney and see if he/she has any information regarding the same, also you can call housing court and talk to the clerk to get an update. You need to get an attorney involved if you are planning on trying to save your home. If not, start packing. Also, check your County's website, your property will be listed in the sheriff sale list and it will be able to tell you if your property has sold or not, whether it was withdrawn due to bankruptcy or when it is scheduled for sale, and whether or not it was sold (check for alias, pluries, etc...) this tells you how many times its been offered at sale and not sold. Hope this helps.
