I bought a foreclosure home from a sheriff sale. Can the people who live there take everything there is?

Question:
I'm afraid they might take the kitchen down, counter top, light fixtures, cabinets, can they do this?

Answer:
Many people will try. I would discuss your problem with the local police and ask for a drive by every couple of hours. Also make sure you check every couple of hours. Remember this is your house now. If you catch them contact the police. You do not want to start anything because the law is on your side. I would also schedual when someone can be present with you when they leave to make sure everything is in order. Many times people are long gone after they do damage or theft and there is no way to get repayment.
Not legally but they will
lol, well what you have is a tenant in accordance to your state's land lord tenant act. You have to follow the procedures to evict them as tenants holding over without permission and you must ask the court to protect any of the real estate from being removed. Depending on your state laws relating to tax sales, you picked up the realty at the sale you did not pick up the personalty at the sale (washing machine, toaster, dogs and cats, mother in law, etc). Therefore technically speaking everything of personal nature still belongs to those tenants holding over without permission and they can take it with them. However everything of permanent nature attached to the real estate is considered real estate. If there is a mobile home, for example, that is still considered a motor vehicle by the laws of your state they can take it since it is of personal nature and not realty.
I would give them an eviction notice if you haven't already and tell them that they will be escorted out. You do have to give them time to get out but let them know that you will invoice them for any furthur damages they incur. Go in and take pictures of the property as soon as possible so you have documentation of how you recieved the property and the condition the tenants vacate the property.
They cannot take anything that is attached, even drapes. They can take free standing appliances and any personal property. If they take light fixtures, etc, you can file theft charges aganist them for recovery.
That isn't to say if they don't take them, they may cause serious damage to them, and walls etc.
